Author [OT] DMCA/Moris
Matthew Sullivan

2004-02-22, 6:34 pm

A little off topic [possibly more appropriate in news.admin.net-abuse.usenet
I think], but couldn't an authority get involved with Moris with respect to
the DMCA?

Doesn't the DMCA provide for people deliberately circumventing security
devices (not just copyright materials)?

Specifically, I have a filter on my news server to stop his posts here, that
is a security device of sorts (it stops his authorised use of my server and
the resources that uses)... By his deliberate and continual morphing he is
knowingly circumventing that said security device... So that surely is a
breach the DMCA?

....and yes I know the DMCA is meant to apply to copyrighted materials, but I
seem to recall that it was so broad it could be applied to just about
anything...? (could be way off the mark, I don't know the DMCA nor pretend
to know it)

... Just a thought ..

You're not in the US and neither is Moris. What makes you think that the
DMCA is relevent?

No.

Yes it does. Famous case of a toner-cartridge re-filler who
reverse-engineered the chip placed on Lexmark cartridges. Lexmark PUT the
chip on the cartridge to prevent re-filling (the chip has to be there for
the printer to work). Injunction under DMCA issued. Case is pending.

Moris might one day visit the US. It would be nice to have him share Dmitri's fate.

WMDs weren't in Baghdad, either. The US government don't let littel things
like inconvenient facts bother them.

It's so broad that playing a copy protected CD in a standard home CD
player violates it. So does the previous sentence. This is true even
if the copy protected CD contains public domain material.
Technologically, it is the single most broken piece of legislation
ever passed.

Technically, you're correct. Now all you have to do is shown thousands
of dollars in damages so that a federal attorney will take the case.
Now, a large ISP, fighting off the Bayesian Busters, they might could
take this course.

ROTFL...!

This newsgroup has become home to total maniacs and madcap spews puppets.

It's no wonder that the number of posts are reducing by each passing day.
Who would want to read, let alone contribute to playground stuff like this
thread? No-one.

Monday - Dec. 8 2003 - Total posts: 692

Monday - Feb. 23 2004 - Total posts: 300

A reduction of 57% in 2 and a half months!

Best to just plonk him and have done. Moris isn't interested in debating
the issue, he just wants to expound his own viewpoint and insult anyone
that doesn't agree.

I'm not a lawyer, but remember that anyone can file a suit (or suite)
against anyone for almost anything. Having it decided in your favor, and
more importantly making sure you don't piss off a judge, is a separate
matter.

Having such a broad application allows the land sharks to earn more
dosh as they seek tenuous legal precedent on a case by case basis.
They lobbied for it to be thus.
Clear cut law's don't permit drawn out legal arguments, bad for
business.

Instead of killfiling by email, killfile by static values in the headers of

Did it morph? Must have missed it. It is my guess that your security device
is not good enough. I have not seen a single post by the troll in around 3
months(blocked by rules on my newsservers themselves) and haven't seen a
followup to its posts in slightly over a month(blocked at the client level).

Think maybe I need to add additional filters to eliminate even more Moronis
garbage. I have a nasty habit of responding to posts that manage to make
it through the filters. My current filters nuke *ALL* of his direct posts
and apparently his morphs since I've seen claims that he does but have yet
to see a post and appear to nuke all followups to his posts through multiple
levels. I just need to make a little refinement so that they also nuke
threads even mentioning Moronis. Then I will not be tempted to respond.
