Can anybody tell me if it is legal to nest a listen shape in a loop shape?

I am creating an orchestration that contains an approval process. In the
listener shape, I have 2 branches, 1 to receive the approval decision and a
second with a delay shape to allow me to send a reminder to the approver if
there is no response within a specified time frame (and continue to do so
while the approval is outstanding)

I've initialized a message receipt control variable and use it in the loop
iteration condition but it always seems to continue to the step following
the loop.

Any help would be greatly appreciated.

Are you sure that the condition is set to False before entering the loop?
