No, he isn't. First of all, the hundreds of people who have been sued
have been people *up*loading music, not downloading. That is why they
were sued.

Second, downloading and listening to that music violates the copyright.
If another band did that song, they'd be violating that copyright. The
people who'd bought or downloaded legally the song from that other
band would not.
