A site that is made up of links and data from search engines....

These sites go and scrape indices to just show some relevant text then it is
really for ads and such. BTW if you don't mind please do not post in HTML.

I have seen sites that use similar techniques, but pull out data from feeds
and bind some adverts to them. First it was E-mail spam, then referrer spam
and now it's search engine spam/mirrors that we suffer from...

When will it end? Are search engines getting their act together?

It may well be related to a scraper site, which takes chunks of other
sites pertaining to the same subject and displays them, thus giving
itself a lot of on-theme content without the tedium of actually having
to write it.

Does that raise any issues of passing off, misleading and deceptive conduct
or trademark infringement?

More a case of e) all of the above. So go waste the next several years
of your life trying to sue or get the site taken down.

It certainly helps if they've got an overture account as I've found
one of their staff very helpful.

Threaten the income and they'll mend their ways. Albeit briefly I'm
sure.

Again part of the problem lies with se picking them up and not
recognising them as rubbish.

The examples Stacey gave are exactly what I've seen a great deal of in the
past coupla months.
You'll notice of course that these sites have up Google's Adsense through
which they'll be earning monies for crappy sites. I'd venture to guess that
any one of these site owners have maybe a dozen or so other similar sites up
(trying to rake in the dough, WELL, adsense doesn't come to alot of money,
but multiply it by 12-20 sites and then what'd've you got?).

A scraper site is a site that takes its entire contents from information
'scraped' from other websites, without taking notice of any robots.txt file.
They are often loaded with keywords that are also 'scraped' from the
overture keyword generator or the google sandbox etc (sometime even their
own keyword databases, if they can be bothered to collect this information
themselves.)

Most search engines and PPC companys scrape information from the net, but
any good robot will check for permission in the robots file first.
Traditionally Scraper sites do not adhere to any rules and may lift entire
paragraphs of your content and whats more they always aim to get these pages
indexed by the major 'bread winner' search engines and appear as your
competition (with your content to do it!)

Some scraper are more complexed they actually make a call to 'scripts' that
you own and use the results as there own, this type of deviency happens alot
to webmasters and is something that most my sites have protection against.
