What is a software patent?
Is it like for example no one being able to release a graphics program
like Photoshop because Adobe holds that patent?

Maybe this will help... http://www.bitlaw.com/software-patent/patentable.html If a computer program simply does calcultions that result is a response that could have been done (eventually) by hand, then it can only be copyrighted. If, however, the program results in a method of delivering information, not just resulting answers, then it is patentable.
